Terms of Service of the Bazhannya Platform

Bazhannya is an online platform for creating, managing, and sharing wishlists. We provide tools that allow you to conveniently organize your wishes and share them with others.

Only individuals who are at least 13 years old may register and use the Service. If you are under 18 years old, you may use the Service only with the consent of your parents or legal guardians.

• You are responsible for maintaining the security of your account (login, password, etc.).
• If you notice any suspicious activity, please notify us immediately.
• You may not share access to your account with third parties.
• One user – one account. Creating multiple accounts without permission is prohibited.

• Create wishlists with descriptions of desired gifts.
• Add photos, links, prices, and detailed descriptions.
• Choose privacy levels (public, friends-only, or private).
• Reserve gifts for friends.
• Share links to wishlists.
• Search for other users and add them as friends.
• View wishlists of friends and other users (if they are public).

• Publish offensive, discriminatory, or illegal content.
• Post spam or advertisements without our permission.
• Impersonate another person or use someone else’s data.
• Attempt to hack the system, steal data, or interfere with the Service.
• Use bots, scripts, or other automated tools without administrative approval.
• Upload malicious software.
• Collect user data for commercial purposes without permission.
• Violate the intellectual property rights of other users.

• You retain all copyright and other intellectual property rights to the content you add (photos, descriptions, titles, etc.).
• By publishing content on Bazhannya, you grant us a non-exclusive, royalty-free, worldwide, sublicensable licence to use, reproduce, display and distribute that content solely for the purpose of operating, supporting and promoting the Service.
• This licence remains in effect until the content or account is deleted. After deletion, content will be removed from public access within a reasonable time.
• By publishing content, you confirm that you hold all necessary rights and permissions for it, and that it does not infringe the rights of third parties.
• We reserve the right to remove content that violates these Terms, applicable law, or the rights of third parties, without prior notice.

• The Service is provided "as is" and "as available" without any express or implied warranties, including warranties of fitness for a particular purpose or uninterrupted availability.
• We strive to ensure stable operation of the Service but do not guarantee uninterrupted operation, freedom from errors, or complete security. Planned and unplanned maintenance may temporarily limit access.
• We are not liable for any direct, indirect, incidental or consequential damages arising from use of or inability to use the Service.
• We are not responsible for the actions, content or behaviour of other users of the Service.
• Bazhannya's total liability to you on any basis shall not exceed the amount you have paid us in the preceding 12 months (or zero if the Service was used free of charge).
• You bear full responsibility for your content, your actions within the Service, and compliance with these Terms.

The design of the Bazhannya service uses illustrations and visual elements from legal sources, including the Streamline library – https://streamlinehq.com.

We respect intellectual property rights and licensing terms of rights holders. If you discover an error, inaccuracy, or a potential copyright infringement related to the use of illustrations or visual materials, please contact us at [email protected].

We are open to dialogue and collaboration and, if an issue is confirmed, we will promptly make the necessary changes, including correcting attribution, replacing, or removing materials.

We reserve the right to suspend or delete an account without prior notice in case of violation of these terms. You may also delete your account самостоятельно through the settings.

If you notice a violation of these terms or illegal content, please report it via the feedback form or by email at [email protected].

We may update these Terms. For material changes, we will notify you on the site or by email at least 14 days before they take effect. By continuing to use the Service after changes, you agree to the new Terms. If you do not agree with the changes, you may delete your account.

These Terms are governed by and construed in accordance with the laws of Ukraine. In relationships with users from the EU, mandatory consumer protection rules of the relevant EU member state also apply.

Any disputes arising in connection with these Terms or use of the Service shall first be resolved through negotiation. If no agreement is reached within 30 days, the dispute shall be submitted to the competent court at Bazhannya's place of establishment, unless otherwise required by mandatory law.

If any provision of these Terms is held to be invalid or unenforceable, it shall not affect the validity and enforceability of the remaining provisions.

Force majeure: Bazhannya shall not be liable for delays or failure to perform obligations due to circumstances beyond reasonable control (natural disasters, armed conflicts, acts of government authorities, global infrastructure failures, etc.).

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Bazhannya regarding use of the Service and supersede all prior understandings.
